Road accident victims are not always aware that third party liability insurance of the perpetrator of an accident not only guarantees the elimination of the damage at the expense of the perpetrator's insurance company, but also guarantees compensation for damage that the victim would not have suffered had the accident not occurred, and so, for example, provides the possibility of applying for reimbursement of the cost of renting a replacement car from the third party liability of the perpetrator of the accident, which the victim may use throughout the period of repair of his/her car or until the moment of purchasing a new one (if we are dealing with total loss). These obligations are imposed on the insurer by the provisions of the Civil Code (Article 361 2 of the Civil Code).
The right to hire a replacement car under the tortfeasor's third party liability is available in almost any case, regardless of whether the damaged vehicle was used in the course of business or privately. The insurer may refuse to reimburse the cost of hiring a replacement car if the insurer can prove that the injured party has another car which can be used while the damaged vehicle is being repaired, or that the injured party has used the damaged vehicle very rarely.
